All clients are subject to the following terms of service which ensure our responsibility to protect each client and to provide the best services available
1.1
The Customer agrees to defend, indemnify, and hold harmless Essex Web Hosts from any claims, damages, losses, or expenses arising from the Customer’s use of the Services.
1.2
Essex Web Hosts may intervene, suspend, or remove services where necessary to protect infrastructure, customers, or comply with legal obligations.
2.1
Services are billed on a recurring basis (monthly unless otherwise stated). A 30-day money-back guarantee applies to hosting services only. Domain registrations, VPN services, SiteLock services, and other third-party or external products are non-refundable.
2.2
All services automatically renew at the end of each billing cycle unless cancelled prior to renewal. It is the Customer’s responsibility to ensure cancellation requests are submitted before the renewal date and to verify that any associated third-party payment subscriptions (including PayPal subscriptions or recurring billing agreements) have been cancelled.
2.3
We accept Visa, Mastercard, and PayPal. Services will not be provisioned or renewed without a valid and authorised payment method on file.
3.1
Invoices are generated based on the original service activation date. Accounts with unpaid invoices may be suspended 20 days after the invoice due date.
3.2
Accounts remaining unpaid for 10 days following suspension may be terminated. Data associated with terminated accounts may be permanently deleted.4.1
Services may be used for lawful purposes only. All applicable laws and regulations must be followed at all times.
4.2
Use of services for illegal, fraudulent, abusive, or harmful activity is strictly prohibited.
4.3
Pornographic or sexually explicit content is not permitted on any services.
4.4
Customers must not disrupt, overload, or degrade infrastructure, networks, or services in any way.
4.5
Prohibited usage includes file hosting, backups, media distribution, peer-to-peer sharing, BitTorrent, Tor exit nodes, CDN services, or similar high-bandwidth distribution unless explicitly authorised in writing.
4.6
Customers must not upload, transmit, or distribute malware, including viruses, worms, trojans, ransomware, spyware, adware, or any malicious or disruptive code.
4.7
Customers are fully responsible for all content, data, applications, and activity associated with their accounts, including any third-party access granted by the Customer.
4.8
Essex Web Hosts reserves the right to suspend or terminate services immediately, with or without notice, where a breach of this policy occurs or where activity presents a risk to infrastructure, security, legal compliance, or other customers.
4.9
Services may also be suspended in accordance with the Copyright Infringement Policy where infringing material is detected or reported.
5.1
Customers must communicate with Essex Web Hosts staff in a professional and respectful manner at all times. Abusive, threatening, harassing, discriminatory, defamatory, or offensive behaviour towards our employees, contractors, or representatives will not be tolerated.
5.2
Essex Web Hosts reserves the right to refuse support, restrict communication channels, suspend services, or terminate services without refund where a customer engages in abusive or inappropriate conduct towards members of staff.
5.3
Examples of prohibited conduct include, but are not limited to, personal insults, harassment, intimidation, threats, discriminatory remarks, excessive hostility, repeated aggressive behaviour, or the use of obscene or offensive language directed at staff including repeated abusive or aggressive communication relating to billing, disputes, or support outcomes.
5.4
Where Essex Web Hosts reasonably believes that the safety, wellbeing, or ability of its staff to perform their duties is being adversely affected by a customer's conduct, immediate action may be taken without prior warning.
5.5
Nothing in this policy prevents customers from raising legitimate complaints, concerns, or disputes in a reasonable and respectful manner.
6.1
Customers must not upload, store, distribute, transmit, publish, or otherwise make available any content that infringes the copyright, trademark, intellectual property rights, or other proprietary rights of any third party.
6.2
Essex Web Hosts reserves the right to investigate any allegation or report of copyright infringement relating to content hosted on or transmitted through its services.
6.3
Where infringing content is identified, reported, or reasonably suspected, Essex Web Hosts may remove the content, restrict access to the content, suspend the affected service, or take any other action deemed necessary to protect its legal interests, customers, infrastructure, or third parties.
6.4
Any service suspended as a result of a copyright infringement complaint shall remain suspended until the infringing material has been removed and Essex Web Hosts is satisfied that the issue has been fully resolved.
6.5
Repeated copyright infringements, failure to remove infringing material, or attempts to circumvent enforcement measures may result in the permanent suspension or termination of services without refund.
6.6
Essex Web Hosts reserves the right to disclose relevant information to copyright holders, law enforcement agencies, courts, regulators, or other competent authorities where required by law or where reasonably necessary to investigate or resolve an infringement complaint.
7.1
Where a service is suspended for any reason, access to the affected service may be restricted or disabled until the underlying issue is resolved to the satisfaction of Essex Web Hosts.
7.2
Suspended services may remain offline for the duration of any investigation, dispute, abuse review, or policy breach remediation.
7.3
Reinstatement of services is subject to compliance with applicable policies, resolution of the issue, and payment of any outstanding balances where applicable.
7.4
Essex Web Hosts reserves the right to refuse reinstatement of services in cases of repeated breaches, serious violations, or risk to infrastructure or customers.
7.5
Data on suspended or terminated services may be retained, deleted, or made inaccessible in accordance with internal retention policies and operational requirements.
7.6
Services that remain suspended due to non-compliance, abuse, unpaid invoices, or unresolved policy breaches may be terminated after a reasonable period at the discretion of Essex Web Hosts.
8.1
Essex Web Hosts shall not be liable for any indirect, incidental, or consequential loss arising from service interruptions, data loss, or system unavailability.
8.2
Our total liability for any claim arising under these terms shall not exceed the amount paid by the Customer for the affected service during the three months preceding the event giving rise to the claim.
9.1
Services are provided on an “as is” and “as available” basis. Essex Web Hosts does not guarantee uninterrupted or error-free operation.
9.2
Some services are resold third-party services. Essex Web Hosts is not responsible for the actions or failures of third-party providers.
9.3
We reserve the right to suspend or terminate services for material breach of these terms, unlawful activity, or risk to our infrastructure.
9.4
Nothing in these terms excludes or limits liability where it would be unlawful to do so under the laws of England and Wales, including liability for death or personal injury caused by negligence or for fraud.
9.5
These terms are governed by and construed in accordance with the laws of England and Wales.
9.6
No service level agreement (SLA) is provided unless explicitly agreed in writing.
10.1
This section defines how policy breaches are handled and how enforcement actions may be applied automatically or manually through internal systems, including WHMCS automation rules.
10.2
Depending on severity, service behaviour, or risk level, actions may be triggered automatically or reviewed manually by Essex Web Hosts staff.
10.3
The following enforcement structure may be applied:
Warning Level: First-time or low-risk policy breaches may result in a formal warning or request for corrective action.
Suspension Level: Moderate or repeated breaches may result in temporary suspension of services, access restriction, or abuse review.
Termination Level: Severe breaches, repeated violations, or high-risk activity may result in immediate termination of services without refund.
Automated Actions: Certain conditions such as non-payment, fraud risk, abuse flags, or infrastructure threats may trigger automatic suspension or restriction via WHMCS or integrated systems.
10.4
Essex Web Hosts reserves full discretion to escalate or bypass any stage of the enforcement process where necessary to protect infrastructure, customers, or legal compliance requirements.
10.5
This enforcement framework is designed to support operational automation and does not limit the right of Essex Web Hosts to take immediate action where required.
