All clients are subject to the following terms of service which ensure our responsibility to protect each client and to provide the best services available
1.1
Reseller Web Hosting provided by Essex Web Hosts allows you to offer web hosting services to your own clients, either by consolidating customer websites into a single managed environment or by enabling your customers to resell hosting services without the need to build, operate, or maintain your own hosting infrastructure.
1.2
The Customer agrees to defend, indemnify, and hold harmless Essex Web Hosts, its officers, employees, agents, and customers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to any service provided, product sold, or action taken by the Customer, its agents, employees, or assigns, including but not limited to injury to persons or property.
1.3
Essex Web Hosts reserves the right to intervene in, suspend, or remove any website or service hosted on its servers where reasonably necessary to protect its infrastructure, customers, or reputation, or to comply with applicable law. Any material supplied by the Customer that infringes or is alleged to infringe third-party intellectual property rights may be removed at our discretion. Essex Web Hosts shall act reasonably when determining whether content violates this policy.
2.1
Services are billed monthly, quarterly, semi-annually, or annually depending on the selected plan. A 30-day money-back guarantee applies to hosting services only, unless otherwise stated. Domain registrations, VPN services, SiteLock services, and other third-party products are non-refundable.
2.2
We accept Visa, Mastercard, and PayPal. Hosting services will not be provisioned without a valid payment method. There are no fixed contract terms; services automatically renew at the end of each billing period unless cancelled prior to renewal.
3.1
Invoices are generated based on the original service activation date. Accounts with unpaid invoices may be suspended 20 days after the invoice due date.
3.2
Accounts remaining unpaid for 10 days following suspension may be terminated. Data associated with terminated accounts may be permanently deleted.
4.1
All services provided by Essex Web Hosts may be used for lawful purposes only. The transmission, storage, or distribution of any material that violates applicable laws or regulations is prohibited, including copyrighted material, obscene or threatening content, or material protected by trade secret.
4.2
The Customer agrees to indemnify and hold harmless Essex Web Hosts from any claims arising from the use or misuse of the Services.
4.3
This Acceptable Use Policy is strictly enforced. Offending content or services may be suspended or terminated upon discovery. Customers will be informed where reasonably practicable.
4.4
Pornographic or sexually explicit material is prohibited on all Essex Web Hosts servers.
4.5
Customers must not use the Services in a manner that places an unreasonable or excessive load on our infrastructure or that interferes with normal service operation.
4.6
The use of the Services for file hosting, data archiving, backup storage, media distribution, peer-to-peer file sharing, BitTorrent, Tor, CDN services, or similar purposes is prohibited unless expressly permitted in writing.
4.7
Customers must not upload, transmit, or distribute any malicious software, including viruses, worms, Trojan horses, spyware, adware, ransomware, or any code intended to disrupt, damage, intercept, or compromise systems, data, or personal information.
5.1
Essex Web Hosts shall not be liable for any indirect, incidental, or consequential loss arising from service interruptions, data loss, or system unavailability.
5.2
Our total liability for any claim arising under these terms shall not exceed the amount paid by the Customer for the affected service during the three months preceding the event giving rise to the claim.
6.1
Services are provided on an “as is” and “as available” basis. Essex Web Hosts does not guarantee uninterrupted or error-free operation.
6.2
Some services are resold third-party services. Essex Web Hosts is not responsible for the actions or failures of third-party providers.
6.3
We reserve the right to suspend or terminate services for material breach of these terms, unlawful activity, or risk to our infrastructure.
6.4
Nothing in these terms excludes or limits liability where it would be unlawful to do so under the laws of England and Wales, including liability for death or personal injury caused by negligence or for fraud.
6.5
These terms are governed by and construed in accordance with the laws of England and Wales.
